Terms of Service

EVT3D (“the Service”) is operated by The Halsey Group, LLC (“we,” “us,” “our”). You can reach us at support@evt3d.app.

EVT3D is currently offered as a private preview. Access is by invitation or approval, features are under active development, and functionality, plans, and pricing may change as the product matures. We will make reasonable efforts to communicate material changes to paying teams in advance.

You must be at least 16 years old and able to form a binding contract to use the Service. Accounts are authenticated through our identity provider; you are responsible for safeguarding your login credentials and for all activity under your account. Provide accurate account information and keep it current. If you use EVT3D on behalf of a company, you represent that you have authority to bind that company to these Terms.

You retain ownership of everything you create or upload to EVT3D — projects, scenes, 3D models, textures, images, floorplans, and other assets (“Your Content”). You grant us a worldwide, non-exclusive license to host, store, process, convert, optimize, render, display, and transmit Your Content solely as needed to operate and improve the Service — for example, converting uploaded models between formats, compressing meshes and textures, generating thumbnails and renders, and delivering scenes to people you share them with.

You are responsible for Your Content. You represent that you own it or have the rights needed to upload it and to grant the license above, and that it does not infringe anyone else’s intellectual property, privacy, or other rights.

EVT3D lets you publish scenes to shareable viewer links. Anyone with a link can view the scene it points to — treat links to confidential designs accordingly. You control creating and revoking your share links and are responsible for what you share through them.

You agree not to:

• break the law, or upload content that is unlawful, infringing, or malicious;
• probe, disrupt, or overload the Service, or bypass access controls or usage limits;
• scrape, resell, or sublicense the Service or its content library without our written permission;
• upload malware or use the Service to distribute it;
• misrepresent your identity or affiliation.

We may suspend or terminate accounts that violate these rules.

Paid plans, photoreal render credits, venue unlocks, and custom onboarding work are billed as described at the time of purchase or in your order agreement. Render credits are consumed when a render is produced and are non-refundable once used. Preview pricing may evolve; pricing changes will not apply retroactively to amounts already paid.

The Service — including its software, design, prop and material libraries, venue models we produce, and documentation — is owned by The Halsey Group, LLC or its licensors and is protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; they do not transfer any ownership in it to you. Library assets we provide may be used within your EVT3D projects and the renders and shares produced from them, but may not be extracted, redistributed, or used outside the Service without our permission.

EVT3D output is a design visualization tool. Scenes, renders, measurements, and layouts produced in EVT3D are illustrative and are not engineering, structural, rigging, electrical, or life-safety documents. You are responsible for verifying weights, loads, rigging, egress, capacity, fire code, and all other regulatory and safety requirements with qualified professionals and the venue before building anything depicted in the Service.

We work hard to keep the Service available and your projects safe, but the Service is provided “as is” and “as available” without warranties of any kind, express or implied. We may modify, suspend, or discontinue features with reasonable notice where practical. Keep local exports of work that is critical to your business.

The Service is built on third-party infrastructure — including identity, hosting, storage, and rendering providers — described in our Privacy Policy. Their availability is outside our control, and their processing of data is governed by their own terms.

You may stop using the Service at any time and may request account deletion at support@evt3d.app. We may suspend or terminate your access for breach of these Terms, unlawful use, or risk to the Service or other users. Sections 4 (license to operate), 8, 9, 13, 14, and 15 survive termination.

To the maximum extent permitted by law, The Halsey Group, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to the Service. Our total liability for any claim arising out of the Service is limited to the greater of (a) the amounts you paid us for the Service in the twelve months before the claim arose, or (b) one hundred U.S. dollars ($100).

You will indemnify and hold harmless The Halsey Group, LLC from claims arising out of Your Content, your use of the Service in violation of these Terms, or your violation of law or third-party rights.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction.

We may update these Terms from time to time. The effective date above reflects the latest revision. Material changes will be announced in the product or by email; continuing to use the Service after changes take effect means you accept the updated Terms.
